Who they are
The Office of the Privacy Commissioner of Canada (OPC) is made up of a committed team of more than 200 data privacy lawyers, auditors, technical advisers, and policy analysts based at its head office in Gatineau, Quebec. OPC is headed by the Privacy Commissioner Philippe Dufresne, an experienced legal authority and independent Agent of Parliament, appointed in 2022 for a term of seven years to ensure that the digital rights of Canadians are protected. The management team of the agency is supplemented by Marc Chénier, the Deputy Commissioner and Senior General Counsel of the office, managing the core legislative compliance and legal enforcement divisions. Working entirely independent of the government cabinet, the group operates as an impartial ombudsman, responsible directly to the House of Commons and the Senate. Collectively, they act as Canada's chief data guardians, investigating breaches of privacy laws, scrutinizing corporate data practices, and protecting the basic right to privacy.
What they do
Office of the Privacy Commissioner of Canada (OPC) is actively overseeing and defending individuals' right to privacy in both the public sector and the private sector. Working as an independent ombudsman, this body is actively investigating citizen complaints about poor handling of data, answering inquiries from citizens, as well as conducting audits of the use of personal information by federal government departments as well as corporations. If there is an occurrence of serious or systemic breaches of privacy rights under the Privacy Act and PIPEDA, the Office will be negotiating a compliance agreement as well as resorting to direct litigation in the Federal Court of Canada. Acting as a regulator, this body will be advising Parliament on the data considerations in legislative processes, issuing specific technological guidance, such as focusing on the protection of children's data as well as the development of ethics of Artificial Intelligence (AI), and organizing a Data Privacy Week each year.
